Penalties for Auto Theft in Arizona

It is important to know the differences regarding the possible charges for theft of a motor vehicle in Arizona. Both of these are defined under separate state statutes.

Arizona Revised Statutes §13-1803

This is referred to as “theft of means of transportation” (TOMOT). This charge will be applied if a person is accused of stealing a vehicle, and they are the driver of the stolen vehicle. TOMOT is considered a class 3 felony offense and is punishable by up to 3.5 years in prison.

Arizona Revised Statutes §13-1814

This is referred to as “unlawful use of means of transportation” (UMOT). This charge will be applied if a person is accused of being a passenger in a stolen vehicle. UMOT is considered a class 5 felony offense and is punishable by up to two years in prison.

What Will a Vehicle Theft Attorney Do To Assist Your Case?

As with all criminal charges, a prosecutor needs to prove beyond a reasonable doubt that a person accused of vehicle theft knowingly acted to deprive a vehicle owner of their property. However, in many cases, auto theft charges are mistakenly applied. This can occur due to miscommunication between a person accused and the vehicle owner. In some cases, a more appropriate charge would be “joyriding,” meaning that a person did take control of another person’s vehicle, but not with the intention to deprive the owner of it permanently.

A skilled Phoenix auto theft attorney will have the resources necessary to conduct a full investigation into the case. A lawyer can often uncover evidence that prosecutors do not have that will be able to show the true intent of their client.
